Man fined after his waste is found dumped within a mass scale fly-tip on A40

A man who failed to carry out proper checks when hiring a waste carrier has paid the price for his error as waste found within a large-scale fly-tip in Denham is traced back to him.

Ninel Seitan, 34, pleaded guilty to the offence of failing in his duty of care when transferring waste to a waste remover when he appeared at High Wycombe Magistrates’ Court on Wednesday on 11 December 2024.

The court heard that on 26 February 2024, a huge fly-tipping operation took place below the A40 fly-over in Denham. Approximately 150 to 200 piles of waste were dumped at the site.

Buckinghamshire Council’s waste enforcement team conducted several examinations of waste at the site. In one of the piles of waste, an enforcement officer found a name and address listing a company in the London area.

After speaking to the company, Buckinghamshire Council were led to Mr Seitan. When officers spoke to Seitan, he explained that he had carried out some work for the company found in the waste. He told officers that he normally uses the same trusted person to remove waste from his work, however on this occasion they were not available. Mr Seitan asked around for someone else who could remove the waste and was given the details of a waste remover, however, he failed to carry out any checks to ensure the remover was reliable and would dispose of the waste legally. Mr Seitan paid the male cash and had his waste removed. The waste was then dumped alongside other waste below the A40.

The Environment Agency, who lead on such matters, is currently investigating possible suspects for the mass fly-tipping at the A40 fly-over with evidence provided to them by Buckinghamshire Council.

Magistrates at High Wycombe Magistrates’ Court fined Mr Seitan £768 and ordered him to pay a contribution of £1,800 towards the council’s investigation costs and the private landowner's clean-up costs. A victim surcharge was also included of £307 – making a total to pay of £2,875.

Thomas Broom, Buckinghamshire Council’s Cabinet Member for Climate Change and Environment said: We have a firm position on fly-tipping – it is against the law, not acceptable and offenders will face zero tolerance consequences.

“This offence was traced back to someone who had not carried out the correct checks on the waste remover and this failure resulted in them being prosecuted themselves. We continue to stress to everyone; do not pay cash for someone to take your waste away, it is not traceable and if the waste is later found dumped, you could be prosecuted.”
